1. Agreement to Terms
These Terms & Conditions ("Terms") govern your use of the website www.mstewartpe.com and the professional engineering services provided by Michael D. Stewart, P.E., LLC ("Company," "we," "us," or "our"). By accessing this website, communicating with us, or engaging our services, you agree to these Terms. If you do not agree, please do not use this website or our services.
2. Professional Engineering Services
Michael D. Stewart, P.E., LLC provides structural engineering services in the State of Florida under Florida license #72459. All engineering work is performed or supervised by a licensed professional engineer. Deliverables, drawings, and calculations are provided for the specific project and scope described in the applicable proposal or contract and may not be reused, copied, or relied upon for any other project without our written consent.
3. Proposals, Contracts, and Payment
Engagements are governed by the specific proposal or contract executed for each project. Unless otherwise stated in that proposal or contract, payment is due within the terms stated on the invoice. Retainers, where required, must be paid before work begins. Documents and sealed deliverables are released upon receipt of payment in full.
4. SMS / Text Messaging Communications
As part of servicing an active engagement, we may exchange one-to-one text (SMS) messages with clients who have an existing business relationship with us. These messages relate solely to your active project — such as scheduling site visits and inspections, coordinating drawings, answering questions, and providing permit or status updates.
- Consent: We send SMS messages only to existing clients who have provided consent, typically verbally or in person, in the course of an active engagement. We do not send marketing or promotional text messages.
- Message frequency: Message frequency varies based on project activity.
- Cost: Message and data rates may apply, depending on your mobile carrier and plan.
- Opt-out: You may opt out of text messages at any time by replying STOP. After you reply STOP, we will send one confirmation message and will not send further texts unless you re-initiate contact.

- Privacy: We do not sell, rent, or share your mobile number or SMS consent with third parties or affiliates for their marketing purposes. To the fullest extent permitted by law, our liability arising out of or related to our services is governed by the terms of the applicable project contract. This website and its content are provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from use of this website.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law provisions. Any dispute shall be resolved in the state or federal courts located in Florida.
